Introduction

OpenSports.com.au is owned and operated by OpenSports Pty Ltd (ABN 44 118 594 504), formerly NavSports Pty Ltd.

OpenSports is a free, comprehensive online platform designed to connect sports individuals, coaches, and organisations across Australia. We are committed to providing a seamless, ad-free experience that fosters engagement, promotion, and meaningful connections within the sports community.

Throughout these Terms, the term “Clubs” refers to organisations, associations, and sporting entities collectively known as “Groups” on the OpenSports Platform.

  1. Acceptance and Modification of Terms

1.1 Acceptance: By accessing and using OpenSports.com.au, you acknowledge and agree to these Terms of Use, establishing a legally binding agreement with OpenSports Pty Ltd.

1.2 Updates: OpenSports reserves the right to modify or update these Terms at any time. Continued use of the Platform following updates constitutes acceptance of the revised Terms.

  1. Account Registration and Usage

2.1 Eligibility: Users must be at least 13 years old to access or register for OpenSports.com.au. Users under 18 require parental or guardian consent.

2.2 Account Responsibilities: You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.

2.3 Acceptable Use: You agree to use OpenSports.com.au in compliance with applicable laws, avoid infringing on others’ rights, and adhere to all content and community standards.

  1. Features for Sports Individuals and Groups (Clubs)

3.1 Profile Creation: Individuals and Groups (Clubs) may create profiles to showcase their sporting services, programs, and achievements.

3.2 Event Listings and Attendance: Groups (Clubs) and businesses can list sports events, while individuals can register attendance or interest through the “Attend” feature.

3.3 Job Listings: Groups (Clubs) and organisations may post employment or volunteer opportunities for the sports community.

3.4 Content Sharing: Users can share updates, photos, and posts to promote sporting events, achievements, or other sports-related content.

  1. Financial Provisions

4.1 No Fees: OpenSports.com.au offers free access to all users and Groups (Clubs), supporting the goal of increasing sports participation and accessibility.

4.2 Donations: Users may provide voluntary, non-refundable donations to assist with operational costs and platform maintenance.

  1. Intellectual Property Rights

5.1 User Content License: By posting content, you grant OpenSports Pty Ltd a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your content on the Platform and associated media.

5.2 OpenSports Content: All OpenSports.com.au content, including text, logos, trademarks, and graphics, remains the property of OpenSports Pty Ltd and may not be copied, modified, or used without written consent.

  1. Privacy, Data Use, and Cookies

6.1 Compliance: OpenSports complies with the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth), and Australian Consumer Law. Personal data is handled in accordance with our Privacy Policy, available on our website.

6.2 Linked Data Analytics: OpenSports collects aggregated, anonymised data to analyse trends, participation levels, and engagement. This data assists OpenSports and partners, including national sporting bodies, in improving programs and sports access. No personal data that identifies users is ever shared.

6.3 Cookies: The Platform may use cookies and analytics tools to enhance performance, measure user activity, and improve functionality. Users can adjust browser settings to manage cookies.

6.4 Your Rights: Users may request access, correction, or deletion of personal information in accordance with the Privacy Act 1988 (Cth).

  1. Dispute Resolution and Legal Compliance

7.1 Indemnification: Users agree to indemnify and hold harmless OpenSports Pty Ltd, its affiliates, and employees from any claims arising from their use of the Platform or breach of these Terms.

7.2 Arbitration: Any disputes arising under these Terms shall first be addressed through negotiation. If unresolved, disputes will be referred to arbitration under the jurisdiction of New South Wales, Australia.

7.3 Limitation of Liability: OpenSports Pty Ltd provides the Platform “as is” and disclaims all implied warranties. To the extent permitted by law, OpenSports shall not be liable for any indirect, incidental, or consequential damages.

  1. General Provisions

8.1 Governing Law: These Terms are governed by the laws of New South Wales, Australia.

8.2 Severability: If any provision is deemed invalid, the remainder of these Terms shall continue in full effect.

8.3 Entire Agreement: These Terms constitute the entire agreement between OpenSports Pty Ltd and its users.

  1. Competitions and Promotions

9.1 Scout Me – Tell Us Your Story: Sponsorship Competition (Australia Wide)

Sponsor: OpenSports Pty Ltd (ABN 44 118 594 504)
Prizes: Two sponsorship awards of $1,000 each (total $2,000 AUD).
Eligibility: Open to aspiring athletes aged 13+ from any sport in Australia.
Entry, privacy, and fair play terms remain identical to the 2024 NavSports competition, with the updated contact email: info@opensports.com.au.

9.2 Sports Club Sponsorship Competition

Sponsor: OpenSports Pty Ltd (ABN 44 118 594 504)
Prizes: Two sponsorship awards of $1,000 each (total $2,000 AUD).
Eligibility: Open to all Australian-based sports Groups (Clubs), charities, associations, and service suppliers.
Terms, conditions, and selection process remain identical to the 2024 NavSports version, with updated contact email: info@opensports.com.au.

9.3 OpenSports Group Sign-Up & Share Competition – Rebel Gift Voucher Giveaway

Sponsor: OpenSports Pty Ltd (ABN 44 118 594 504)
Eligibility: Open to all verified Groups (Clubs) registered on OpenSports.com.au.

Entry Process:

  1. Each Group (Club) that creates a verified OpenSports profile will have a Facebook post created by OpenSports.
  2. The Group must share this post publicly to encourage members and friends to engage.

Prizes: Rebel Sport gift vouchers, as detailed in the official competition post.

Conditions:

  • Entries must comply with Facebook’s Community Guidelines.
  • Fake accounts, paid engagement, or artificial interaction will result in disqualification.
  • Only verified Group (Club) profiles are eligible to claim prizes.
  • Promotional Video Requirement
    Acceptance of any prize is conditional upon the winning club or athlete providing a short video thanking OpenSports Australia for the Rebel voucher giveaway and acknowledging their success in the competition. The winning club or athlete grants OpenSports Australia permission to use this video for promotional and marketing purposes, including display on OpenSports.com.au and the official OpenSports Facebook page.
